Wildlife and Development

In the UK, there are a number of species that receive protection under domestic or European Legislation.  At its full extent this makes it a criminal offence to disturb, kill or injure a protected species.  There are also a number of species that are protected under policy.  Whilst this does not afford the same amount of protection, it means that local authorities are still required to protect them from development. 

1)      Any site that contains suitable habitat to support such species will be required to have an Ecological Survey in order to maintain compliance with the law.  Phase One Surveys can be undertaken at any time of year, although the optimum period is between April and September. 

2)      If the presence of a protected species is likely a Presence or Absence Survey may be required to understand which species are present, how they are using the site, and the impact any development or change in management might have.  It might also be necessary to establish the size of the population.

3)      Ecological mitigation or compensation measures might be necessary to offset any impact.  These are in reparation for the loss of habitat in areas occupied by Protected Species and might include the creation of new habitat or the enhanced management of existing habitat.

4)      Increasingly, successful planning applications are agreed subject to mitigation conditions and require on-site supervision during development by a trained ecologist.  This is to ensure biodiversity gains are secured and the impact on the habitat or protected species is either avoided or minimised.
